Responsibilities

Description of the Business Line or Department

The key objective of the Financial Crime Team is to prevent SG Kleinwort Hambros (KH) breaching any law or regulation relating to financial crime by providing guidance to the KH Group on anti-money laundering, countering terrorist financing, the criminal facilitation of tax evasion, sanctions and anti-bribery and corruption (“financial crime”).

Summary of the key purposes of the role

  • To work alongside the Group Head of Financial Crime and other CAFC colleagues to provide guidance to management and staff of KH across all group entities so that the business remains compliant with all relevant sanctions regulations, legislation, Group Sanctions Policy and industry best practice
  • To monitor the effectiveness of KH Sanctions Compliance Program on a group wide basis, and ensure that sanctions related policies, procedures, systems and controls are being complied with, working effectively and are properly embedded across all group entities
  • To provide sanctions related management information (MI) to senior management, commercial directors and key support functions to evidence the effectiveness of the KH sanctions compliance program on a group wide basis and to inform decision making at all levels of the organisation.
  • To act as the main contact point for all sanctions related matters with Head Office, regulators and government agencies

Summary of responsibilities

  • Maintaining KH sanctions related policies, procedures and guidance notes such that they are in compliance with Head Office Instructions and UK, Channel Islands and Gibraltar regulations;
  • Providing support, advice and guidance to all KH staff in all sanctions related matters;
  • Providing support and guidance to the Group Monitoring Unit with respect to transaction sanctions monitoring;
  • Providing support to the Operations team with respect to Requests for Information from correspondent banks;
  • Receiving, investigating and reporting (to relevant regulators) sanctions related issues escalated by management or staff;
  • Reviewing existing and new account files to ensure that all sanctions issues are identified, investigated, remediated and and documented and attend the reputational risk committee to represent the sanctions view, where necessary;
  • Escalating to management and Head Office any identified potential weaknesses in the sanctions systems and controls within SGH;
  • Completing the annual sanctions risk assessment;
  • Assessing the impact on KH of forthcoming changes in sanctions regulations;
  • Developing and strengthening relationships with the business heads, relationship managers, operations managers and staff to promote best practice and ensure a good understanding of economic sanctions requirements;
  • Identifying sanctions related training needs, developing appropriate tools, drafting training decks and delivering face-to-face training;
  • Maintaining comprehensive monitoring programmes to check that business continues to be conducted in compliance with all relevant sanctions obligations;
  • Taking responsibility for all Head Office imposed projects which impact on KH sanctions compliance;
  • Draft and execute controls to ensure that sanctions policies and processes are being adhered to;
  • Support the MLRO with preparation for internal audit or compliance assurance reviews;
  • Review sanctions clauses alongside the legal department, to ensure KH is sufficiently protected;
  • Undertaking capacity planning to ensure KH have sufficient sanctions resource;
  • Liaise with external counsel and other sanctions-related vendors, as required; and
  • Perform all duties in accordance with the principles outlined in the Kleinwort Hambros Code of Conduct, as well as the policies and procedures relevant to your responsibilities, to ensure that you adhere to a culture that treats clients fairly and focuses on the long-term sustainability of client relationships.

Profile required

Competencies

  • Experience in Private Banking/Wealth Management

  • Knowledge of regulatory and legal requirements with respect to sanctions issued by OFAC, EU, UK and the UN. 
  • Knowledge and experience of providing guidance on sanctions to staff / management
  • Communication – written and verbal to all levels of the organisation (including Head Office) and to external third parties including regulators
  • Decision making – consider and recommend escalations to Head Office, regulators and relevant government agencies, having conducted autonomous investigations
  • Influencing –persuade and influence management and staff across KH
  • Project Management – participate and where necessary lead/manage
  • Strategic and Commercial Awareness – develop and apply commercial awareness and business acumen in all day to day and longer-term tasks
