Responsibilities

In this position, the hired candidate will handle regulatory enforcement matters and litigations; civil, administrative and criminal subpoenas and requests for information; and a host or related legal tasks and functions. More specifically, this includes the following, among other things:

  • Managing a docket of regulatory enforcement and litigation matters, and advising and consulting the relevant business lines/management on these matters
  • Handling regulatory enforcement inquiries and investigations, primarily from FINRA and the exchanges/execution venues of which SG entities are members, the SEC, the CFTC, and other relevant entities
  • Managing counsel (in those matters when external counsel is brought in) throughout the matter, and with external counsel, developing strategy and tactics, managing the interactions with internal constituencies; assessing and communicating the risks; overseeing disclosure/discovery; developing settlement recommendations (when applicable); ensuring cost effective legal spend
  • Handling civil, administrative, and criminal inquiries, subpoenas, etc., including negotiating scope, drafting objections and responses; collecting information and data for production; etc.
  • Conducting internal investigations relating to potential enforcement, pre-litigation, employment, disciplinary, and other matters
  • Assisting with the reporting function, including reporting to management, auditors, regulators, insurers, etc.
  • Handling and facilitating eDiscovery and related matters, with assistance from internal eDiscovery personnel and resources.

DIVISION DESCRIPTION: 
The mission of the Legal Department is to protect Societe Generale from legal, regulatory, reputational, and other risks, while at the same time assisting the business units in the achievement of their legitimate business interests by providing effective and quality legal services and advice, drafting and reviewing legal documentation and ensuring that business is conducted in compliance with relevant laws and regulations.  The Legal Department is also responsible for (a) overseeing litigation, enforcement actions and investigations; (b) promoting strong and ethical legal culture within the Americas; and (c) identifying and mitigating legal risk arising. The members of the Canadian Legal Department work closely with the American Legal Department as we form the Americas Legal Group and thereby collaborate on regional projects and strive to align on key principles, policies and procedures, and on cross-border business transactions and activities.

SKILLS AND QUALIFICATIONS:

Competencies:  

  • Strong written and oral communication skills, including the ability to clearly, persuasively, and efficiently communicate complex matters.
  • Ability to effectively interact with management and other internal stakeholder on complex and high-stakes issues.
  • Ability to work independently and to manage and prioritize a diverse docket of time-sensitive matters, tasks, deliverable, etc.
  • Ability to mobilize diverse stakeholders within the bank to achieve results necessary for positive legal outcomes.
  • An innovative, flexible and creative personality with a willingness to take on new challenges and responsibilities.
  • Ability to influence and persuade others and to take and defend a position in absence of broad-based support;
  • Strong planning and organizational skills and attention to detail.
  • Familiarity with e-discovery and related legal operational and technical matters.  
  • Ability to understand how complex systems within a financial institution and to understand how information is stored, communicated and maintained in such systems. 

Desired / Plus:

  • Experience with and knowledge of legal issues impacting financial institutions.
  • Understanding of banking, securities and futures industry regulations and norms.

Qualifications (Experience, Education, Languages):

  • Experience as litigator (2+ years) at an established law firm and/or experience as an in-house litigator experience in securities and banking litigation.
  • Member, New York State Bar

Education:  

  • Law degree from a US law school
  • Undergraduate degree from a 4-year college/university

COMPENSATION:
Base salary range does not include overtime pay, bonus and/or other benefits, where applicable. Actual base salary offer will vary based on skills and experience. The role is eligible for an annual discretionary bonus and includes a competitive benefits package including 401(k) plan with company match, medical/dental/vision, and other benefits for fertility, wellness, student loans and commuters.
